Genetic information includes information about:
- An individual's genetic tests
- Genetic tests of family members
- Family medical history
- Requests for or receipt of genetic services
- Genetic information of a fetus or embryo
The Genetic Information Nondiscrimination Act (GINA) prohibits employers from: - Using genetic information in employment decisions - Requesting, requiring, or purchasing genetic information - Disclosing genetic information
GINA works alongside the ADA: - GINA protects against discrimination based on genetic predisposition - The ADA protects against discrimination based on current disabilities
Exception: Inadvertent acquisition of genetic information is not a violation if the employer doesn't use it in decision-making.
