Qualified Individual
A person who can perform the essential functions of a job with or without reasonable accommodation.
Under the ADA, a qualified individual is someone who:
1. Satisfies the job-related requirements of the position (education, experience, skills, licenses) 2. Can perform the essential functions of the job with or without reasonable accommodation
Both elements must be met for ADA protection. This means: - You must meet the legitimate qualifications for the job - You must be able to do the core duties, possibly with accommodation - An employer cannot refuse to hire or retain you based on inability to perform marginal functions
The analysis is done at the time of the employment action (hiring, firing, etc.), not based on speculation about future limitations.
