When telework may be appropriate: - The essential job functions can be performed remotely - The employee's disability makes commuting or being onsite difficult - Environmental factors at the worksite exacerbate the disability - Concentration or privacy needs are better met at home
Considerations: - Can essential functions be performed remotely? - Does the job require physical presence? - What supervision is needed? - What technology is required?
The COVID-19 pandemic demonstrated many jobs can be performed remotely. This experience is relevant evidence when employers claim remote work isn't feasible for similar positions.
An employer cannot deny telework simply because it hasn't been done before if the job duties can actually be performed remotely.
